Carrier Liability

A carrier's legal responsibility for freight loss, delay, or damage, usually limited to a specific weight, volume, or declared value of goods.

What is Carrier Liability?

Carrier liability determines a motor carrier's legal responsibility for damaged or lost freight. Exclusions include weight limits, declared values, or exceptions under the Carmack Amendment, a federal statue in the 49 U.S. Code § 14706.

The Carmack Amendment does not hold carriers responsible for freight that is lost or damaged in transit by an:

  1. Act of shipper
  2. Act of god
  3. Act of public authority
  4. Act of public enemy
  5. Inherent nature of goods
